Provisions
1. Scope of Application
The following General Terms and Conditions apply to all
orders placed via our online shop by consumers and entrepreneurs.
A consumer is any natural person who enters into a legal
transaction for purposes that can predominantly be attributed neither to their
commercial nor to their independent professional activity.
An entrepreneur is a natural or legal person or a
partnership with legal capacity who, when entering into a legal transaction,
acts in the exercise of their commercial or independent professional activity.
The following applies to entrepreneurs: If the entrepreneur
uses conflicting or supplementary General Terms and Conditions, their validity
is hereby rejected; they shall only become part of the contract if we have
expressly agreed to them.
2. Contracting Party, Conclusion of Contract, Correction
Options
The purchase contract is concluded with EXIM Welt GmbH.
By placing the products in the online shop, we make a
binding offer to conclude a contract for these products.
You may initially place our products in the shopping cart
without obligation and may correct your entries at any time before submitting
your binding order by using the correction tools provided and explained during
the ordering process.
The contract is concluded when you accept the offer for the
products contained in the shopping cart by clicking the order button.
Immediately after submitting the order, you will receive an
order confirmation by email.
3. Contract Language, Storage of Contract Text
The language(s) available for the conclusion of the contract
are: German, English.
We do not store the contract text.
4. Subject Matter of the Contract
4.1 Product Description
The respective product description forms an essential part
of the contract.

Without prejudice to your statutory warranty rights, we
would like to draw your attention to the following special features. If you are
unsure, please contact us:
Due to individual screen configurations, such as resolution
and brightness, slight differences between the colours shown and the actual
product colours may occur.
For wooden products, natural variations in the grain,
structure and colour of the wood may occur.
5. Delivery Conditions
5.1 Delivery Area
We deliver within Germany.
5.2 Shipping Costs
Standard delivery is free of charge.
5.3 Delivery Options
We ship the products to the delivery address specified
during the ordering process.
You generally have the option of collecting your order from:

5.4 Delivery by Freight Forwarder
Appointment arrangement
For deliveries by freight forwarder, the freight forwarding
company commissioned by us will contact you in order to arrange a delivery
date.
Place of delivery
Delivery of the goods is limited to transporting and
unloading the goods at the first public kerbside of the agreed delivery
address.
Unless expressly agreed otherwise, delivery does not include
delivery into specific rooms or the assembly and/or installation of the ordered
goods.
6. Payment
6.1 Prices
The prices stated at the time of the order apply.
These are total prices and include the statutory value-added
tax.
6.2 Payment Methods
The following payment methods are generally available in our
shop.
Advance payment
If you select advance payment, we will provide you with our
bank details in a separate email and will deliver the goods after receipt of
payment.
Cash payment upon collection
You pay the invoice amount in cash when collecting the
goods.
Credit card
During the ordering process, you enter your credit card
details.
Your card will be charged immediately after the order has
been placed.
SEPA Direct Debit
By placing the order, you issue us with a SEPA direct debit
mandate.
We will notify you of the date on which your account will be
debited at least one banking business day in advance (so-called
prenotification).
A banking business day is any working day except Saturdays,
nationwide public holidays, and 24 and 31 December of each year.
Your account will be debited before the goods are
dispatched.
Apple Pay
In order to pay the invoice amount via the payment service
provider Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA (“Apple”),
you must use the Safari browser, be registered with Apple, have activated the
Apple Pay function, authenticate yourself using your login details and confirm
the payment instruction.
The payment transaction is carried out immediately after the
order has been placed.

Klarna
In cooperation with the payment service provider Klarna Bank
AB (publ.), Sveavägen 46, 111 34 Stockholm, Sweden (“Klarna”), we offer you the
payment options listed below.
Unless otherwise stated below, payment via Klarna requires a
successful address and creditworthiness check and is made directly to Klarna.
Further information is provided for the respective payment
option and during the ordering process.
Purchase on account via Klarna
The invoice amount is due 30 days after dispatch of the
goods and receipt of the invoice.
Payment by invoice can only be used by consumers.
Klarna may offer registered Klarna customers selected
according to its own criteria additional payment options within their customer
account.
We have no influence over whether these payment options are
offered; any individually offered payment options concern your legal
relationship with Klarna.

Credit card via Klarna
During the ordering process, you enter your credit card
details.
Your card will be charged by Klarna immediately after the
order has been placed.
No address or creditworthiness check is carried out.
Direct debit via Klarna
You issue Klarna with a SEPA direct debit mandate.
Klarna will notify you of the date on which your account
will be debited (so-called prenotification).
Your account will be debited after the goods have been
dispatched.
Instalment purchase via Klarna
You can pay the invoice amount in up to 36 monthly
instalments.
For some orders, a down payment may be required.
The due dates are determined by Klarna's payment schedule.
The instalment purchase payment method via Klarna can only
be used by consumers.
Klarna may offer registered Klarna customers selected
according to its own criteria additional payment options in their customer
account, for example interest-free instalment plans.
We have no influence over whether these payment options are
offered; any individually offered payment options concern your legal
relationship with Klarna.

Pay immediately via Klarna
In order to pay the invoice amount using Klarna's immediate
payment option, you must have a Klarna account and a bank account enabled for
online banking, authenticate yourself accordingly and confirm the payment
instruction.
No creditworthiness check is carried out when using the
immediate payment option.
Your account will be debited immediately after the order has
been placed.

PayPal
In order to pay the invoice amount via the payment service
provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22–24 Boulevard Royal, L-2449
Luxembourg (“PayPal”), you must be registered with PayPal, authenticate
yourself using your login details and confirm the payment instruction.
The payment transaction is carried out by PayPal immediately
after the order has been placed.
Further information is provided during the ordering process.
PayPal may offer registered PayPal customers selected
according to its own criteria additional payment options within their customer
account.
We have no influence over whether these payment options are
offered; any individually offered payment options concern your legal
relationship with PayPal.

option, you must be registered with PayPal, authenticate yourself using your
login details and confirm the payment instruction.

We have no influence over whether these payment options are
offered; any individually offered payment options concern your legal

Your card will be charged by PayPal after the goods have
been dispatched.
Purchase on account via PayPal
Purchase on account via PayPal requires an address and
creditworthiness check and payment is made directly to PayPal.
Purchase on account via PayPal and Ratepay
Purchase on account via PayPal requires an address and
creditworthiness check and payment is made directly to Ratepay GmbH,
Franklinstraße 28–29, 10587 Berlin (“Ratepay”).
Invoice
The invoice amount is due for payment by bank transfer to
the bank account specified on the invoice within 7 days after receipt of the
invoice and the goods.
We reserve the right to offer purchase on account only after
a successful creditworthiness check.
7. Right of Withdrawal
You have the statutory right of withdrawal as described in
the withdrawal instructions.
8. Transport Damage
The following applies to consumers:
If goods are delivered with obvious transport damage, please
report such damage to the delivery company as soon as possible and contact us
immediately.
Failure to make a complaint or contact us has no
consequences whatsoever for your statutory claims and their enforcement, in
particular your statutory warranty rights.
However, by doing so you help us to assert our own claims
against the carrier and/or the transport insurance provider.
The following applies to entrepreneurs:
The risk of accidental loss and accidental deterioration
passes to you as soon as we have handed over the goods to the freight
forwarder, carrier or other person or institution commissioned to carry out the
shipment.
9. Data Backup
You are responsible for properly and regularly backing up
your data.
We are not liable for damage resulting from the loss of data
insofar as you could have prevented the data loss by carrying out regular and
complete backups.
The above limitation does not apply to claims based on
damage caused by us, our legal representatives or agents:
- in
the event of injury to life, body or health;
- in
the event of intentional or grossly negligent breach of duty or fraudulent
intent;
- in
the event of a breach of material contractual obligations, the fulfilment
of which is essential for the proper performance of the contract and on
compliance with which the contracting party may regularly rely (cardinal
obligations);
- within
the scope of a guarantee, where agreed; or
- insofar
as the German Product Liability Act applies.
10. Warranty and Guarantees
Statutory Liability for Defects
Unless expressly agreed otherwise below, the statutory law
governing liability for defects applies.
The following limitations and reductions of limitation
periods do not apply to claims based on damage caused by us, our legal
representatives or agents:
- in
the event of injury to life, body or health;
- in
the event of intentional or grossly negligent breach of duty or fraudulent
intent;
- in
the event of a breach of material contractual obligations, the fulfilment
of which is essential for the proper performance of the contract and on
compliance with which the contracting party may regularly rely (cardinal
obligations);
- within
the scope of a guarantee, where agreed; or
- insofar
as the German Product Liability Act applies.
Restrictions Applicable to Entrepreneurs
In relation to entrepreneurs, only our own information and
the manufacturer's product descriptions incorporated into the contract shall be
deemed to constitute an agreement regarding the quality of the goods.
We assume no liability for public statements made by the
manufacturer or other advertising statements.
For entrepreneurs, the limitation period for claims for
defects relating to newly manufactured goods is one year from the transfer of
risk.
The preceding sentence does not apply to an item that has
been used for a building in accordance with its usual intended purpose and has
caused the building to be defective.
The statutory limitation periods for recourse claims
pursuant to Section 445a of the German Civil Code (BGB) remain unaffected.
Information for Merchants
Among merchants, the inspection and notification obligation
stipulated in Section 377 of the German Commercial Code (HGB) applies.
If you fail to provide the notification required thereunder,
the goods shall be deemed approved unless the defect was not detectable during
the inspection.
This does not apply if we fraudulently concealed a defect.
Information for Consumers
When purchasing goods, the statutory warranty period has a
minimum duration of two years.
With regard to the statutory warranty for goods, please also
note the harmonised notice pursuant to Implementing Regulation (EU) 2025/1960
(the so-called warranty label).

11. Liability
We shall always be liable without limitation for claims
based on damage caused by us, our legal representatives or agents:
- in
the event of injury to life, body or health;
- in
the event of intentional or grossly negligent breach of duty;
- in
the case of guarantees, where agreed; or
- insofar
as the German Product Liability Act applies.
In the event of a slightly negligent breach by us, our legal
representatives or agents of material contractual obligations, the fulfilment
of which is essential for the proper performance of the contract and on
compliance with which the contracting party may regularly rely (cardinal
obligations), liability shall be limited in amount to the damage foreseeable at
the time the contract was concluded and which must typically be expected to
occur.
Otherwise, claims for damages are excluded.

13. Dispute Resolution
We are neither obliged nor willing to participate in dispute
resolution proceedings before a consumer arbitration board.
14. Protection of Minors
If your order includes products whose sale is subject to age
restrictions, we ensure, by using a reliable procedure involving personal
identity and age verification, that the person placing the order has reached
the required minimum age.
Where delivery takes place, the delivery company will hand
over the goods only after successful age verification and only to the person
who placed the order.
Delivery to parcel lockers is not possible in this case.
15. Final Provisions
If you are an entrepreneur, German law shall apply,
excluding the United Nations Convention on Contracts for the International Sale
of Goods (CISG).
